Construction Law & Litigation
Our construction law department features four of only 223 lawyers in the State of Florida that are designated by the Florida Bar as construction law experts. We have represented contractors, owners, sub-trades, suppliers, design professionals, sureties, and lenders, in a variety of contractual disputes, statutory actions, and general transactions. Our attorneys have successfully resolved hundreds of construction disputes. Our attorneys practice in state and federal Courts, U.S. Bankruptcy Courts, The United States Court of Federal Claims, and a variety of arbitration and mediation forums.
We specialize in this area of the law for several reasons. First, we have practical experiences contracting construction jobs and we understand the issues that arise in this area. Construction law involves complex statutes such as the lien law, decades of common law (court decisions,) and complex contractual issues. Therefore, we feel that limiting the focus of our practice is necessary in order to offer our client’s greater value and higher quality representation.
The best way to “win a lawsuit” is to avoid being a party to a law suit if possible. We constantly emphasize the value of our early involvement in the contract phase of construction projects in an effort to avoid litigation and to promote the successful completion of each job. We cannot stress enough the importance of contacting us before you sign a contract. The law changes every year, which means “standard” contracts may be outdated and portions of them may be unenforceable. By focusing primarily on the area of construction law and because of our legal and construction experience, we offer our clients an opportunity to avoid many disagreements that seem to plague the industry.
Representing construction clients also requires knowledge of the business aspects of their companies. As a result, we also handle more general business issues including structuring business entities such as corporations, advising on the related issues of taxation, reviewing contracts, and other services to help our clients in their businesses.
We understand our clients’ need to receive timely and accurate legal information. We also are aware of the importance of keeping our clients constantly informed and updated as to the status of their case. Finally, we recognize the benefits to our clients of striving to work within their legal budgets. Unlike most construction law firms, our attorneys will consider taking a case on a contingency basis. In a contingency case, clients may not have to pay any legal fees unless and until money is recovered form another party to the dispute.
