Design Defects
A contractor has a duty to build according to the plans and specifications. Sometimes constructon methods and materials are fine, but there are defective plans and specifications. Design defects can result in project delays and related costs, corective work, redesign costs, and other unexpected expenses. Breach of contract claims for design have a four year statute of limitations that starts to run from the date of discovery of the design defect. A professional malpractice claim against the individual design professional must be made within two years of the discovery of a defective design.
